The regulations in force in the Kingdom of Saudi Arabia have helped clarify the legal procedures followed when issuing deportation and expulsion decisions against foreign violators. This is due to the importance of these decisions and their long-term impact on the stability and lives of residents in the Kingdom. Therefore, it is important to clarify the mechanism of action of these decisions, determine the cases of deportation and expulsion, their expiration date, and the penalties for violators.

The difference between deportation and removal is that deportation is a legal procedure issued by an administrative decision or judicial ruling preventing a non-Saudi person from entering the Kingdom for a specific period or permanently. Deportation is applied for security reasons or when committing certain crimes.

Deportation is an administrative procedure carried out to remove a non-Saudi person from the Kingdom immediately without requiring that he be prevented from returning, and deportation applies in certain cases such as the expiration of the period of residence without renewing the required documents, the lack of regular residence, or working without a permit.

  • Issuance of an administrative or judicial decision stipulating the deportation of the foreign person.
  • The deportation decision must be reasoned and the violating person must be notified of the decision.
  • The decision must be implemented through the Ministry of Interior in coordination with other parties.
  • Observe Hajj and Umrah instructions.

The Anti-Narcotics and Psychotropic Substances Law stipulates the penalty of deportation from Saudi Arabia due to drugs, whereby a foreigner is deported after the expiry of the sentence imposed on him and is not allowed to return to it except as permitted by the instructions of Hajj and Umrah.

  • Committing a major crime requiring arrest or crimes of witchcraft and sorcery.
  • If he is sentenced to imprisonment for a period of not less than 3 months or flogging with not less than 40 lashes.

The citizen’s son or husband is excluded from the decision of the Minister of Interior.

The deportation ruling from Saudi Arabia is implemented after the issuance of an official decision by the competent authorities or a judicial ruling that includes the deportation of the convict after the implementation of the penalty imposed against him. The Ministry of Interior, represented by the Deportation and Deportation Department, is responsible for implementing the decision in cooperation with the relevant competent authorities.

The expatriate can submit a request for exemption from deportation through the Ministry of Interior website by following the following steps:

The deportation decision ends upon the expiration of the period specified in the decision or in the judicial ruling issued by the Saudi courts, and the expatriate has the right to submit a request for exemption from deportation or object to the judicial ruling within the specified dates while providing the reasons supporting the request, especially if the deportation from the Kingdom is permanent.

The passport deportation procedure requires that the foreigner commit a violation of residency, work, and border security regulations, including:

  • If the expatriate works for himself or for someone else without obtaining a permit from the competent authorities “bulk labor”
  • Running away or being absent from work for a long time.
  • The expatriate was late in leaving after the expiration of the entry visa granted to him.
  • Irregular infiltration into Saudi territory.

Final exit is the expatriate’s request to leave the Kingdom’s territory on a regular and permanent basis after the expiration of the visa or work permit. The final exit request is submitted by the expatriate or the employer if the worker works for him. The request is submitted electronically via the Absher platform or the Muqeem platform affiliated with the General Directorate of Passports.

While deportation is a coercive measure implemented by the competent authorities, and is carried out without the expatriate’s consent when he commits a violation of residency, work, and border security regulations.

The second clause of the rules for dealing with expatriates who violate the regulations stipulates deportation procedures in the following detail:
