Since its inception, the Kingdom of Saudi Arabia has guaranteed patients’ rights and provided the treatment and health care required to ensure individual health and safety.

The Basic Law of Governance stipulates that health services must be provided to every citizen and resident on its territory, including mental health care.

The mental health care system regulates the mechanism for providing the necessary psychological care to people suffering from mental disorders by providing rehabilitation and treatment services in specialized health facilities.

The system aims to:

  • Organizing and promoting mental health care for psychiatric patients.
  • Preserving the rights of the mentally ill.
  • Explaining how to treat a person with a mental disorder and how to treat them in health facilities.
  • Receive due diligence in a safe and clean environment.
  • Respect his rights and dignity.
  • Inform him of the medical diagnosis of his condition and the progress of the treatment plan before starting treatment.
  • Do not give him experimental treatment or any type of treatment unless written consent is obtained from him.
  • Inform him of the treatment services available at the facility and how to obtain them.
  • Protect him from degrading treatment or financial, physical or sexual exploitation.
  • Do not use or threaten physical or moral punishment.
  • Maintain his freedom and do not isolate him except in certain cases and for a period specified by the doctor supervising the treatment.
  • Providing him with freedom of movement inside and outside the treatment facility if it complies with safety requirements.
  • His retention or guardian of personal property in his possession and the use of means of communication in a manner that does not conflict with safety requirements.
  • Enabling it to receive visitors.
  • Keep his information confidential.
  • He has the right to seek the assistance of a legal exorcist to promote him after coordination with the treating physician.
  • Enabling him or his guardian to file a complaint against any person or treatment facility if there is a reason.
  • Inform him or his guardian of his mandatory entry into the treatment facility when issuing the mandatory entry decision and inform him of the reason for entry in writing.

Government agencies do not have the right to dismiss an employee due to illness. Rather, one of the rights of a mentally ill person at work is the right to obtain sick leave to receive the necessary treatment, provided that a medical examination is submitted stating the patient’s health condition and his need to receive treatment.

A psychiatric patient is not held accountable for the actions he commits if he proves that he suffers from a mental illness that affects the integrity of his perception through a detailed psychiatric report from an accredited mental health facility.

The basic principle is that the admission of a mentally ill patient to a mental health facility to receive treatment is optional and requires the consent of the patient or his guardian if he is unable to make the decision himself.

Article Thirteen of the Mental Health Care System pdf stipulates that a mentally ill patient may not be forcibly admitted to the facility without obtaining his consent or the consent of his guardian unless all of the following conditions are met:

  • The patient suffers from a severe psychological disorder that causes danger to him or others.
  • The admission of a mentally ill patient to the facility must be necessary to cure his illness and prevent the deterioration of his health.
  • Submit a medical report detailing the patient’s condition, written and signed by certified psychiatrists.

The mental health care system pdf imposes specific penalties in Article 25 on anyone who violates the rights of the mentally ill in Saudi Arabia, which are:

  • The penalty shall be imprisonment for a period not exceeding two years and a fine not exceeding 200,000 Saudi riyals, or one of two penalties:
    • A practitioner in a mental health facility who intentionally proves in his report what is contrary to a person’s psychological state with the intention of admitting or removing him from the hospital.
    • Who intentionally detained or caused a person to be detained as a mentally ill person in cases other than those stipulated in the system.
