Government lands represent an integral part of state property and must be protected from any encroachment or illegal exploitation due to their importance in development projects that serve all segments of society.

The new encroachment system aims to regulate the process of removing encroachments, identify the competent authority to monitor government lands and detect violations in accordance with specific controls and requirements set by control committees, and clarify the method of reporting encroachments and the penalties imposed on violators.

These are the rules and decisions issued in the new encroachment system to protect government lands from encroachment, build on them without a license, and punish violators.

  • The Government Land Encroachments Committee is responsible for monitoring state properties, monitoring encroachments, and supervising their removal in accordance with the following conditions:
  • The land subject to encroachment must belong to the state.
  • The incident must be documented with photos and documents before removal.
  • The removal decision must be issued by a committee approved by the emirate of the region in which the encroachment is located or the competent authority.
  • Property and adjacent land must not be damaged when encroachment is removed.
  • Security authorities must be present when implementing the removal decision.
  • The Encroachment Removal Committee monitors the infringement or initiates reports submitted.
  • Inspect the property or land and ensure that the property is available and documented.
  • Notifying the trespasser that the trespass must be removed within a specified period of time.
  • Carrying out the removal process at the expense of the infringer if he refuses to implement the committee’s decision.

The trespasser on government lands is required to remove the trespass and pay the costs of returning the trespassed land to its natural state within 10 days and to pay compensation to the affected parties if the trespasser performs any of the actions mentioned in Article 1 of the Rules for Monitoring State Real Estate and Removing Trespass, which are:

  • Seizing or disposing of any state property without a license.
  • Preventing others from entering the property.
  • Changing the features of the property in any way, such as planning it, planting it, building on it, placing barriers on it, or exploiting it permanently or temporarily.

Yes, the violator has the right to object to the removal decision within the period stated in the report, writing the reason for the objection, such as proving his ownership of the land and attaching the title deed or attaching an official license to benefit from the land issued by a government agency.

Individuals or companies can inquire about the State Real Estate Authority’s treatment to know the reports received on the ground or the decisions of the infringement committees through the Authority’s website.

A citizen or resident can report any encroachment on government lands through the website of the emirate of the region in which the encroachment occurred.

For example, if the infringement is located in the Riyadh region, the whistleblower can access the Riyadh Region Emirate website and follow the following steps:

  • Log in to the Riyadh Region Emirate portal through the unified national access.
  • From the list of electronic services, select “All services”
