The dowry recovery lawsuit is one of the most common personal status lawsuits, because of the important financial and legal consequences it entails after divorce or termination of the marriage contract.

The Personal Status Law and its executive regulations are keen to regulate this lawsuit with precise conditions and controls that preserve the rights of spouses and prevent disputes.

Because regulatory details can make a big difference in accepting or rejecting a lawsuit, consulting a competent lawyer is an essential step before starting the procedures.

Article 36 of the Personal Status Law defines dowry as the money paid by a man to a woman due to a marriage contract.

The dowry, according to the system, is the property of the woman and the husband may not take it away from her, and he is obligated to pay the dowry on the dates agreed upon in the marriage contract.

Everything a man gives to a woman is considered a gift in a marriage contract unless it is customary to consider it part of the dowry or the man declares that the gifts are part of the dowry.

It is a lawsuit filed by the husband or wife before the personal status courts to recover part or all of the dowry.

The ruling on recovering the dowry is permissible and stipulated in Islamic law and local regulations, subject to reasonable conditions and regulations.

Certain conditions and criteria are required for accepting a claim to recover the dowry, which are determined by the Personal Status Court before deciding the claim, including:

  • The reason for divorce or separation must be legitimate, such as harm or injury.
  • Determine the time of separation between spouses before or after consummation.
  • The presence of proof of payment or the wife’s acknowledgment of receipt of the dowry in full.
  • The existence of a written condition or agreement in the marriage contract stipulating cases of return of the dowry in a manner that does not violate the provisions of the system.

Spouses have the right to recover the full value of the dowry in accordance with Article 105 of the Personal Status Law in the following cases:

  • If the annulment after consummation is due to a defect in the wife, she has the right to keep the dowry.
  • Cases of returning the dowry to the husband:
  • If the reason for annulment is due to a defect in one of the spouses before consummation.
  • If the woman requests annulment before consummation and the husband refuses to divorce or divorce her.
  • If the woman requests termination of the marriage contract before consummation for a reason attributable to her.
  • The wife’s failure to fulfill the conditions stipulated in the contract.
  • If both parties agree to divorce.

“Some may think that recovering the dowry is an absolute right, while the truth is that the system links accepting a dowry recovery claim to specific reasons and precise regulatory procedures. Here the importance of hiring a personal status lawyer appears to understand your legal position, prepare the lawsuit document, and represent you before the court correctly.

The judge rules that the husband is entitled to half the dowry if the reason for the annulment is a dispute between the spouses, and it is not known who caused the dispute and there is no real harm that would require the annulment of the marriage contract.

The necessary legal documents must be available to prove the claim, such as the date of the marriage contract, proof of receipt of the dowry, etc., so that the beneficiary can file a lawsuit demanding the return of the dowry.

The lawsuit is filed through the Najiz platform of the Ministry of Justice by following the following steps:

  • Log in to the Najiz platform through the National Unified Access Account.
  • From the home page select “Judiciary”
  • Access the service “lawsuit papers”
  • Click on the icon ” new request”
  • Determine the classification of the case “personal status”
  • Determine the classification of sub-claim “marriage and band claims”
  • Determine the type of lawsuit “dowry claim”
  • Fill out the required data and attach documents supporting the lawsuit.

Filing a claim to recover the dowry without knowing the regulatory conditions or case law may expose the claim to rejection or delay.
