In Saudi Arabia, a marriage contract is a legal and regular contract that allows spouses to agree on certain terms in the marriage contract, ensuring clarity of rights and obligations between them.

The Saudi Personal Status Law regulates these conditions and specifies when they are valid and binding on both parties.

Article 6 of the Personal Status Law defines a marriage contract as a contract between a man and a woman that has pillars and conditions that entail rights and duties between the two parties.

The marriage contract aims to achieve chastity, protection, and the formation of a stable family that the spouses can care for with affection and mercy.

  • The spouses are the man and woman who wish to marry.
  • Affirmation is permission to marry issued by the woman’s guardian.
  • Acceptance is the husband’s approval to marry the woman.

It is everything that one spouse stipulates for the other in the marriage contract.

Islamic law and the Saudi system permit spouses to set conditions in a valid marriage contract in accordance with the following controls:

  • The condition must be written in the marriage contract.
  • The condition must not conflict with the purpose of the marriage contract.
  • These conditions should not make what is forbidden permissible or what is forbidden permissible.

Spouses have the right to write the conditions they deem necessary in the marriage contract in order to ensure the other party’s commitment to implementing them and his approval of them.

  • Determine the value of the dowry.
  • Late dowry requirement.
  • To have independent housing.
  • To complete her education.
  • Not to prevent her from working.
  • Not to marry another woman.
  • To bring her a domestic worker or a private driver.
  • To stay with her parents if they need her help because of their old age.
  • Not to take her out of the city she is in.
  • To cover her Hajj expenses.
  • To stay at home and supervise the care of the children.
  • The woman should not travel without the husband’s consent.
  • Living with the husband in the city where he lives.

In some cases, you may need to clarify the legal effect of the terms of the marriage contract or know your rights when they are violated.

Here comes the role of the personal status lawyer from the Binh application, as it provides you with specialized legal advice, helps you understand your legal rights and deal with disputes related to marriage contracts in accordance with Saudi regulations.

Corrupt conditions are conditions that are not valid in a marriage contract. Article 29 of the Personal Status Law stipulates two types of these conditions:

  • Conditions that contradict the basic purpose of marriage, such as requiring that the marriage be for one year, which is contrary because the basic principle of marriage is continuity, or that the marriage contract be without a dowry.
  • Conditions that violate Islamic law or public order and morals, such as one spouse requiring the other to use drugs with him.

Article 28 of the system stipulates that if one spouse does not meet the other party’s conditions, that party has the right to request termination of the marriage contract from the Personal Status Court unless he explicitly waives his right.

Compensation for termination of the contract due to failure to fulfill the condition shall be in two cases:

  • If the wife is the one who violated the husband’s conditions, she must pay compensation of the same value as the dowry or less upon termination of the marriage contract.
  • If the husband is the one who violated the wife’s conditions, the annulment will be without compensation.

Islamic law and the Saudi system guarantee the rights of the wife over her husband in the marriage contract, and these rights include:

  • Cohabitation with kindness, respect and good treatment.
  • Not to harm her, whether materially or morally, such as cursing or swearing.
  • Alimony for her.
  • Justice between wives if the husband is polygamous.
  • Not abandoning it.

Understanding the terms in the marriage contract and knowing their legal implications helps spouses ensure clarity of rights and obligations between them and avoid any future disputes.

If there are questions about the validity of these terms or how to formulate and document them correctly, hiring a skilled lawyer in personal status cases is an important step.
