Cases that may lead to cancellation of premium residency
The Saudi law has identified clear and specific cases that lead to the cancellation of distinguished residency, in addition to the effects that result from this cancellation. These cases are mainly based on Article 9 of the Premium Residency Law.
Basic cases for canceling premium residency:
According to Article 9 of the Premium Residency System, residency is cancelled in the following cases:
- Conviction of a crime: If a holder of a distinguished residence permit is issued a final judicial ruling convicting him of a crime punishable by imprisonment for a period of not less than (sixty) days, or a fine of not less than (one hundred) thousand Saudi riyals or its equivalent.
- Deportation from the Kingdom: In the event that a final administrative decision or judicial ruling is issued to deport the holder of distinguished residency from the Kingdom.
- Providing incorrect information: If it is proven that the application for distinguished residency included incorrect information, approval is based on it.
- Non-compliance with obligations: In the event that the holder of distinguished residency does not comply with the obligations stipulated in Article Seven of the system (which relate to his duties).
- Relay waiver: If the holder of the premium residence officially waives it through the procedures specified by the premium residence center.
- Death or loss of eligibility: Residence ends with the death or loss of eligibility of the holder.
In addition to the above, the second paragraph of Article Nine granted the competent committee the right to terminate the distinguished residence if the public interest so requires.
Implications of residency cancellation:
When the distinguished residence permit is cancelled or terminated, it has several important consequences stipulated in the executive regulations of the distinguished residence permit law:
- Cancellation of family residence: As a general rule, if a person’s residence is cancelled, the cards of his family members will be cancelled accordingly, in accordance with Article 10 of the Executive Regulations. The only exception is in the event of the death or loss of eligibility of the residence holder, where his family can continue to enjoy rights and benefits until the end of the residence period.
- Leaving the Kingdom: The procedure resulting from cancellation or termination is the departure of the residence holder and his family from the Kingdom.
- Grace period (liquidation period): A residence holder whose residence has been cancelled shall be granted a period not exceeding (60) sixty days to remain in the Kingdom to liquidate all his rights and obligations. The head of the center may extend this period to a maximum of (180) days if necessary, in accordance with Article Eleven of the Regulations.
- Forfeiture of rights and benefits: Once canceled, all rights and benefits acquired under the distinguished residency system, such as owning property, practicing business, etc., will be forfeited from the residence holder, and the center will notify the relevant authorities of this.
