The crime of murder in the Kingdom of Saudi Arabia is proven based on the provisions of Islamic Sharia, the provisions of the Code of Criminal Procedure and its regulations, and judicial principles. The methods of proof adopted vary and include the following:
Acknowledgment (confession):
The accused’s confession is considered one of the strongest pieces of evidence, and the system has given him strict guarantees in major crimes such as murder; Article (one hundred and first) of the Code of Criminal Procedure stipulates that: “If the accused confesses during the investigation to a crime that requires murder, amputation, or retaliation for the soul or less, his confession shall be authenticated by the competent court, with this recorded in the seizure in the presence of the seizure clerk and his signature”. This ensures that recognition is issued voluntarily, without coercion and with full capacity.
Clues and physical evidence (forensic evidence):
Courts are not limited to confession or testimony in proving murder crimes. Rather, proof extends to all modern forensic and scientific evidence (such as genetic fingerprints, fingerprints, forensic reports, and the seizure of the murder weapon).
Article (fifty-four) of the Executive Regulations of the Criminal Procedure System states that the investigator assigns forensic experts to search for traces that are useful in the investigation, such as footprints, fingerprints, blood stains, and examining clothing.
The Supreme Court, in its Circular No. (13/T/7901), emphasized the principle of flexibility of criminal proof, stating that “the court’s authority to prove conviction is not bound by specific means of proof, but rather the conviction is proven by all means that the court is convinced of the accused’s commission, according to the evidence presented to it, including valid clues.”

Testimony (evidence):
This is the testimony of witnesses who witnessed the murder. The testimony is subject to the judge’s discretion in terms of the justice of the witnesses and the conformity of their testimony with reality and other material evidence presented from the crime scene.
Aliquot:
It is an exceptional method of proving legitimacy that is resorted to in blood cases when there is “pollution” (which is the strong evidence that favors the plaintiff in determining the murder rate of the accused) without complete evidence, as the blood relatives swear fifty oaths that the accused is the one who killed the victim. The Supreme Court restricted its ruling in its Circular No. (13/T/8412), which established an important principle that reads: “The department shall not rule on it if there is evidence or valid proof that contradicts its ruling.”
Conclusion: Proof of murder is achieved through the integration of evidence, whether through a legally confirmed confession, the testimony of credible witnesses, or through forensic evidence and conclusive material evidence that generates complete conviction in the competent court.
