In light of the rapid digital development and total reliance on technology in the business sector, compliance with technical controls is no longer just a routine administrative procedure, but has become an inevitable necessity.

Today, the National Cybersecurity Authority, as the regulatory body responsible for protecting cyberspace in the Kingdom, stands guard against any negligence that may threaten data security, imposing strict penalties that may undermine your facility’s budget and destroy the trust of your customers.

Cybersecurity means protecting networks, information technology systems, data, etc., from any hacking, disruption, illegal use or exploitation in accordance with the definition contained in Article One of the regulations of the National Cybersecurity Authority.

The Authority is the authority responsible for cybersecurity in Saudi Arabia and aims to protect the vital interests of the state and its national security.

  • Preparing the national cybersecurity strategy.
  • Notifying stakeholders of risks and threats related to cybersecurity.
  • Building national operations centers for cybersecurity.
  • Regulating the mechanism for sharing information and data related to cybersecurity.
  • Providing assistance to the relevant authorities.
  • Building specialized national capacities in the fields of cybersecurity.
  • Licensing individuals and non-governmental entities to engage in activities and operations related to cybersecurity.
  • Raising awareness of cybersecurity.

The Authority has identified four basic controls that are appropriate for cybersecurity for all government and private sectors in the Kingdom, and each party must adhere to them:

  • Cybersecurity governance: This ensures that the entity’s business plans, projects, and initiatives contribute to achieving regulatory and legislative requirements in Saudi Arabia.
  • Enhancing cybersecurity: Ensuring cybersecurity protection, preventing unauthorized access, and protecting the entity’s networks, data, devices, and infrastructure from cyber risks.
  • Cybersecurity Resilience: Ensuring that the impacts of disruptions in electronic services are addressed and reduced.
  • Third-party cybersecurity and cloud computing: Ensure that an entity’s assets are protected from third-party cybersecurity risks and implement requirements for cloud computing.

Article 1 clarifies the regulatory capabilities of the National Cybersecurity Authority for actions that constitute a violation of cybersecurity in Saudi Arabia, which are:

  1. Carrying out any activities or operations related to cybersecurity without obtaining a license from the Authority.
  2. Failure to adhere to the policies, governance mechanisms and controls established by the Authority.
  3. Providing misleading data to the public, public or private entities related to the provision of activities or services related to cybersecurity.
  4. Refrain from providing the Authority with the necessary information, reports or documents it requests.
  5. Possessing, selling, importing, exporting, renting, making available, manufacturing or using any device, tool, service or software related to cybersecurity in a manner that does not comply with the Authority’s requirements or without obtaining a license.
  6. Obstructing inspectors from performing their duties, preventing them from doing so, or failing to cooperate with them and provide them with facilities.
  7. Any other action that violates the regulations and decisions related to cybersecurity activity issued by the Authority.

Anyone who commits any of the violations stipulated in the regulatory possibilities or contributes to committing them shall be punished with one or more of the following penalties:

  • Alarm.
  • Temporarily suspend the license.
  • License cancellation.
  • Stop the service or activity.
  • A fine not exceeding 25 million Saudi riyals.
  • The ruling was published at the violator’s expense in a local newspaper.
  • Obligating the violator to remove the violation.

Avoiding violations by the National Cybersecurity Authority is no longer a secondary option; it is the cornerstone of your company’s financial stability and protecting its reputation in the digital marketplace. However, if your facility faces any violation notices or is issued sudden fines and decisions, random dealing may complicate the situation and double losses.
