The Ministry of Human Resources and Social Development has been keen to regulate job advertisements through controls aimed at enhancing transparency, achieving equal opportunities, and protecting the rights of parties to the contractual relationship.

Therefore, adhering to job advertisement controls is not limited to complying with regulations, but also contributes to building a professional work environment and spares establishments violations and penalties.

A job advertisement means that the establishment publishes an advertisement that includes its desire to attract specific cadres to work for it, specifying the employment conditions and specifications required for the applicant in a manner that does not violate the provisions of the Saudi Labor Law and the regulations in force in the Kingdom.

The Ministry of Human Resources and Social Development supervises the announcement of government and private sector jobs, and sets controls and requirements that ensure the provision of equal and appropriate job opportunities for job seekers.

Article 3 of the Saudi Labor Law states that the following conditions must be met when announcing a vacant position within an establishment:

  • Providing Saudi citizens with employment: Work is considered a citizen’s right and no one else may practice it except after meeting the conditions stipulated in the system.
  • Non-discrimination in job advertisements: The establishment may not practice any form of discrimination on the basis of gender, disability, age, marital status, etc., whether when hiring or advertising government or private jobs.

Article 4 of the Ministerial Resolution on Controls for Announcing Vacancies and Conducting Job Interviews stipulates the necessary requirements for advertising government jobs and in the private sector, which are:

  • The advertised jobs must be compatible with the professions included in the Saudi Unified Classification of Professions.
  • Job vacancies must be announced via the Ministry’s approved digital platforms, the facility’s website, official social media accounts, or licensed job fairs.
  • Receiving job applications must be electronic.

Reviewing job advertisements before publishing them is an important step to avoid regulatory violations and protect the organization from any legal consequences. A labor lawyer from the office of Attorney Abdul Majeed Al Rashid will assist you in ensuring that your advertisement complies with the regulations and provide the necessary advice.

    • Nature of work and hours.
    • Functional advantages.
  • Determine the duration of applying for the job vacancy (the start date of application and the end of the job advertisement).

The establishment must take into account the controls stipulated in Paragraph (c) of Article 4 of the Ministerial Resolution when conducting job interviews for its vacant positions, which are:

  • List the applicants for the job interview and send an invitation to notify each applicant of the type of interview (in-person – remote – telephone), its date and the expected time for conducting it, no less than 3 working days before the date.
  • The interview location must be:
    • Suitable in proportion to the number of job applicants.
    • Visibly with open entrances and exits with adequate desks and seats for applicants.
    • Compliance with occupational safety and health requirements that protect applicants.
    • It has an electronic security system or security guard.
    • It offers restrooms according to the gender of the applicants and provides potable water.
