The presence of a female guardian is a prerequisite for the validity of a marriage contract, according to the Saudi Personal Status Law, which is derived from the provisions of Islamic Sharia. This requirement is designed to ensure the protection of rights and the legitimate interests of women.

The role of the guardian is not considered a formality, but rather an essential element that directly affects the validity of the marriage contract and its legal effects.

With the many questions about this condition, the importance of understanding the provisions of guardianship in marriage as decided by Sharia and regulated by the system emerges, in a way that ensures the clarity and safety of procedures.

He is the person who has the authority to marry a woman in accordance with the provisions of Islamic Sharia, the Saudi Personal Status Law, and its executive regulations.

In the marriage contract, the guardian is responsible for marrying the woman to whoever he deems competent for her and issues an offer, which is considered one of the pillars of marriage, such as his saying “Your wife is my daughter or my sister so-and-so”

The guardian system prohibits him from marrying his mistress without her consent, even if he is her father, and the marriage contract must include proof of the woman’s satisfaction with this marriage.

The guardian in marriage is considered a condition for the validity of marriage according to the provisions of Islamic law, as it was mentioned in the noble hadith that he, may God’s prayers and peace be upon him, said “There is no marriage except with a guardian”.

The new personal status system clarified the ruling on a marriage contract: If it is concluded without a guardian, the marriage is invalid and must be annulled by the competent court

A woman’s guardian is subject to the conditions stipulated in Article 18 of the Personal Status Law, which are:

  • The guardian must be male.
  • He must be sane, so guardianship is not valid for a crazy or insane person.
  • The guardian reaches the age of majority at 18 years.
  • The guardian agrees with the woman in religion, so the guardian must not be a non-Muslim.

Article 17 of the system explains the order of a woman’s guardian in marriage as follows:

  • Father
  • A guardian appointed by the father when he is disabled, sick, or after his death.
  • Grandfather to father and exalt.
  • The son, then his son, even if he comes down.
  • Brother brother.
  • Brother to father.
  • The nephew, even if he comes down.
  • A nephew belongs to a father, even if he descends.
  • Brother uncle.
  • Uncle to father.
  • A full cousin, even if he comes down.
  • A cousin of a father, even if he descends.
  • The closest league to the order of inheritance.
  • A judge or a person appointed by the court to marry a woman.

A woman can choose her guardian in marriage when they are equal in rank, such as full brothers or full uncles, so she may choose one of them to marry her in accordance with what is stipulated in Article 17 of the system.
