I had a financial case against him and the ruling was issued in it, and I settled a reconsideration of the petition and they put 10,000 on the judicial costs, do they come with the same amount, and I settled an objection to the petition, prepared, and the request was rejected, but I want to know whether they put it on the costs

Yes, the amount charged to you is correct and regular.

According to Article 6 of the Executive Regulations of the Judicial Costs System, the costs of the “Request for Reconsideration” have been set at a lump sum of ten thousand riyals.

The answer is: No, retracting the request or trying to cancel it does not exempt you from paying the judicial costs that were imposed.

The judicial cost is the consideration for registering the application with the court and considering it, and once you formally submit the application, the obligation to pay these costs arises. Rejecting your request to object to the petition (i.e. retract it) confirms that the action has been officially registered and cannot simply be cancelled.

This is the most important point in your position. The system clearly defines the consequences of non-payment of the costs of a reconsideration petition. According to paragraph (2) of Article Twelve of the Judicial Costs System:

“The applicant for a reconsideration petition shall be given a period of (thirty) days from the date of filing the application with the competent court to pay the judicial costs… If he does not pay within this period, the court shall rule that his right to the application has been forfeited, and the ruling shall be considered final.”

  • If you do not pay the amount of 10,000 riyals within 30 days from the date of submitting your petition, the court will not consider the cohesion and will issue a ruling that “your right to request has been forfeited”.
  • “Lapse of the right to request” means that the cohesion is formally rejected due to non-payment of fees, and the original judgment against you becomes final and enforceable.
  • Very important: The loss of your right to request does not mean that you no longer owe the amount. The cost has already been charged for the action it initiated and remains claimed by the Department of Justice as an outstanding debt.
  • The amount of 10,000 riyals is the correct regular cost for requesting a reconsideration petition.
  • Your withdrawal of the request does not exempt you from paying the amount, especially since your request to withdraw has been rejected.
  • If you do not pay the amount within the specified period, its direct result is that you reject cohesion in form, but this does not cancel the debt you owe to the state.

Judicial costs of requesting a reconsideration petition

The Judicial Costs System does not include a case for recovering the amount or exempting it in the event that the petitioner retracts his request, unlike some other cases stipulated in Article Sixteen of the System (such as reconciliation before the first session or the issuance of a ruling in favor of the cost payer), which do not apply to your case.
