Article eighty-four of the Code of Criminal Procedure stipulates:

The investigator may not seize any papers or documents held by the accused’s agent or lawyer that the accused has handed over to him to perform the task entrusted to him, nor any correspondence exchanged between them in the case

  1. The papers and documents you handed over to your lawyer or agent in order to perform the defense mission or agency you assigned to him.
  2. Correspondence exchanged between you and your lawyer or agent in the case under investigation.

Accordingly, the investigator may not seize these documents or correspondence held by the lawyer or agent whenever they are related to the case and the defense mission assigned to him.

However, if you are detained and an order is issued preventing you from contacting others or prohibiting visits, your contact with your lawyer or agent shall not be forfeited; Article Eighty-Two of the Executive Regulations requires that this contact be with the knowledge of the investigator. The regulations also specify the maximum total duration of orders to prevent contact and prevent visits at sixty days.
