The worker has the right to recover the medical expenses he paid for treatment from his own money in the event that the employer fails to provide him with medical insurance.

The Saudi regimes have explicitly and unambiguously guaranteed this right, based on the following regulatory principles:

Article 10 of the Cooperative Health Insurance System stipulates that: “The employer shall bear the costs of the treatment of the beneficiary of the insurance in the period that elapses between the date on which the treatment is due and the date of participation in the cooperative health insurance.” This text establishes a clear rule that the employer’s failure to provide medical insurance or delay in issuing it makes him obligated and directly responsible for paying the actual medical expenses that the worker needed during that period.

Article 144 of the Labor Law affirms this obligation, stating that: “The employer must provide his workers with preventive and curative health care in accordance with the levels decided by the Minister, taking into account what is provided by the cooperative health insurance system.”

Conclusion: Since the employer has breached its statutory obligation to provide medical insurance, it replaces the insurance company in bearing the costs of treatment. You have the right to claim a refund of all bills and medical expenses you have paid, and if your employer refuses to pay them, you can file a lawsuit to demand compensation for these financial expenses.
